Welcome to MyFriend (“MyFriend,” “we,” “us,” or “our”). By accessing or using our services through MyFriend.com, you (“you,” “user,” or “customer”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

1. Eligibility

   You must be at least 20 years old to use MyFriend. By using our service, you confirm that you meet this age requirement and have the legal capacity to enter into this agreement.

2. Description of Services

   MyFriend provides casual, uplifting, and light-hearted phone conversations on neutral, everyday topics. Our hosts offer friendly companionship—not professional advice. We do not provide:

   • Therapy or counseling
   • Medical, legal, or financial advice
   • Crisis intervention or emergency support

3. Emergency and Crisis Disclaimer

   MyFriend is not a substitute for emergency services.

   • If you are experiencing a medical emergency, call 911.
   • If you are in emotional distress or suicidal crisis, call or text 988 (Suicide & Crisis Lifeline).

4. Scheduling and Payment Terms

   • Payment is required at the time of scheduling. $50.00 for every 30 minutes slot.
   • Customers must provide the telephone number they will use to call in.
   • If Customers call from another phone number than that listed, we cannot guarantee connection with our services.
   • Customers are responsible for calling in at their scheduled time. No extended time will be honored if customer calls in late.
   • Missed calls or failure to call at the scheduled time will not be refunded.
   • If a session is disrupted due to technical issues beyond MyFriend’s control, a refund will be issued.

5. User Conduct

   You agree to use MyFriend respectfully and lawfully. The following behaviors are strictly prohibited:

   • Sexual, explicit, or suggestive content
   • Harassment, hate speech, or abusive language.
   • Sharing or soliciting personal, medical, financial, or legal information
   • Impersonation or misrepresentation
   • Any illegal activity

   We reserve the right to terminate any call or account that violates these standards. No refunds will be issued for calls terminated due to misconduct.

6. Privacy and Data

   We respect your privacy. While we strive to maintain a secure environment, no system is completely foolproof.

   • We do not record or store conversations unless required by law or for service integrity.

7. Intellectual Property

   All content, branding, and materials associated with MyFriend are the property of MyFriend.com. You may not copy, reproduce, distribute, or modify any part of our service without prior written consent.

8. Disclaimers

   MyFriend is provided on an “as-is” and “as-available” basis. We make no warranties or guarantees regarding the availability, accuracy, or outcomes of our service. We are not liable for any damages, losses, or emotional distress resulting from your use of the service.

9. Limitation of Liability

   To the maximum extent permitted by law, MyFriend shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

10. Indemnification

    You agree to indemnify and hold harmless MyFriend, its employees, and affiliates from any claims, liabilities, damages, or expenses arising from your use of the service or violation of these Terms.

11. Force Majeure

    MyFriend shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, or governmental actions.

12. Termination

    We reserve the right to suspend or terminate your access to the service at any time, with or without notice, for any reason, including violation of these Terms.

13. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved exclusively in the courts located in Trenton, NJ. You agree to waive any right to participate in class actions or jury trials.

14. Severability

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Modifications to Terms

    We may update these Terms at any time. Changes will be posted on our website, and continued use of the service after changes are posted constitutes acceptance of the revised Terms.

16. Fees & Services

    Participants are solely responsible for any fees or charges imposed by their communication providers. Services are hosted in the United States and conducted in English.
